01 Eligibility
You must be at least 13 years old to use Wakr. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.
02 License
Subject to your compliance with these Terms, Lunar Solutions grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. You agree not to:
- Reverse engineer or attempt to extract the source code.
- Use the App for any unlawful purpose.
- Sublicense, sell, or transfer your rights to the App.
03 Subscriptions and Payments
3.1 — Free and premium tiers
Wakr offers a free tier with limited features and a premium subscription ("Wakr Pro") with full access to all challenge types and features.
3.2 — Subscription terms
- Subscriptions are available on a monthly or yearly basis.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price as the original subscription.
3.3 — Refunds
Refund requests must be submitted directly to Apple in accordance with Apple's refund policies. We do not independently issue refunds.
3.4 — Price changes
We reserve the right to modify subscription pricing. You will be notified of any price changes before they take effect, and your continued subscription after the effective date constitutes acceptance of the new price.
04 Permissions and Device Access
4.1 — Notifications
Wakr requires notification permissions to function as an alarm. If you deny notification permission, alarm delivery may not work as intended. You can manage notification permissions in your iOS Settings at any time.
4.2 — Camera
Photo-based challenges require camera access. Camera permission is requested only when you attempt a photo challenge. You can revoke camera access at any time in iOS Settings.
4.3 — Alarm delivery
Wakr will attempt to trigger alarms at your configured times. Alarm delivery depends on your device settings and iOS system behavior. We cannot guarantee alarm delivery in all device states (e.g., low battery, Do Not Disturb, restricted background activity).
05 Acceptable Use
You agree not to use the App to:
- Submit false or misleading verification photos to circumvent challenge requirements.
- Attempt to hack, scrape, or interfere with the App or its services.
- Use the App in any way that violates applicable laws or regulations.
- Attempt to bypass subscription restrictions or access premium features without a valid subscription.
06 Intellectual Property
All content, trademarks, and software in the App are owned by or licensed to Lunar Solutions. You acquire no rights to our intellectual property except the limited license set out in Section 2.
07 Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
— THE APP WILL BE UNINTERRUPTED OR ERROR-FREE
— ALARMS WILL FIRE AT THE EXACT SCHEDULED TIME IN ALL DEVICE CONDITIONS
— CHALLENGE VERIFICATION VIA AI WILL BE 100% ACCURATE AT ALL TIMES
Wakr is a productivity and wellness tool and is not intended as a substitute for medical advice, professional guidance, or emergency wake-up services. Do not rely solely on Wakr for time-critical obligations.
08 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNAR SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DAMAGES FOR MISSED ALARMS, MISSED APPOINTMENTS, OR ANY OTHER LOSS RESULTING FROM APP MALFUNCTION OR UNAVAILABILITY.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR A SUBSCRIPTION IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
09 Third-Party Services
The App integrates third-party services including RevenueCat (subscription management) and Google Gemini AI (image verification). Your use of those services is also subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.
10 Termination
We may suspend or terminate your access to the App, at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use the App ends immediately. Active subscription refunds upon termination will be handled in accordance with Apple's policies.
11 Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via an in-app notice or by updating the "Last updated" date above. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
12 Governing Law
These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles.
